Introduction

Brewszilla Private Limited ("Brewszilla") welcomes you to the Brewszilla website and app, and these Terms of Service ("Terms") form a binding agreement between you and Brewszilla governing your access to and use of the platform and the services offered through it.

These Terms are an electronic record recognized under the Information Technology Act, 2000 and may be accepted electronically without any physical or digital signatures.

By using the platform, you acknowledge that these Terms define the rights, responsibilities, and obligations of both parties for all actions, transactions, communications, and activities undertaken through the platform.

Services and scope

The platform provides access to products, features, content, tools, data, and interactions offered directly by Brewszilla or enabled via third‑party service providers integrated into the platform from time to time.

Service descriptions and functionality may evolve, and access may be governed by additional policies, guidelines, or supplemental terms presented within the platform.

Acceptance and contract

Visiting, browsing, accessing, or using the platform constitutes affirmative acceptance of these Terms and creates a valid contract under the Indian Contract Act, 1872.

Contracts formed through electronic means are valid and enforceable under section 10A of the Information Technology Act, 2000.

Eligibility

Use of the platform is restricted to individuals who are at least eighteen years of age and otherwise competent to contract under applicable law.

If you lack legal capacity, are prohibited by applicable law, or your account has previously been disabled for violations, you must not use the platform.

You represent that your use complies with local law and that you are not barred from receiving services under applicable regulations.

Lawful use and compliance

You agree to use the platform in accordance with Indian law, including the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

Brewszilla may implement due‑diligence, notice‑and‑takedown, and grievance redressal measures consistent with these rules.

Territorial scope

The platform is operated and controlled from India and is not directed to jurisdictions where distribution or use would be contrary to law or would subject Brewszilla to registration or other requirements.

Access from locations where such access is illegal is prohibited.

Privacy reference

Your use of the platform is also governed by Brewszilla's Privacy Policy, which explains how information is collected, used, stored, shared, and protected.

Brewszilla's handling of sensitive personal data or information will align with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

Changes to terms

Brewszilla may update these Terms from time to time, with changes taking effect upon posting within the platform.

Continued access or use after changes indicates acceptance of the revised Terms, and users should review the latest version periodically.

Account closure and termination

If you do not agree to these Terms or any updates, you must stop using the platform and may terminate the relationship by closing your account.

Brewszilla may refuse or limit service or close accounts where required to comply with law or to protect users or the platform.

Electronic communications

You consent to receive communications electronically and agree that electronic records and notices satisfy legal requirements for written communications.

Use of platform and role

Brewszilla Private Limited ("Brewszilla") provides access to the Brewszilla app, website and related services, which may include features, content, tools, data, communications, and integrations with selected third‑party service providers made available from time to time.

Brewszilla may act as an organizer for certain offerings or as a limited facilitator for third‑party services, and Users agree that any third‑party tools or gateways are governed by their own terms in addition to these Terms.

Use of the platform must comply with applicable Indian law including the Information Technology Act, 2000 and relevant rules and guidelines for intermediaries and digital media ethics.

In‑person social events

Brewszilla may organise and host in‑person social events ("Events") and use the platform to promote Events and connect with Users who wish to participate and meet new or known attendees.

Brewszilla controls the scheduling and operational elements of Events, including venue, timing, eligibility, features, activities, duration, menu choices, and participant management at its discretion.

Images, descriptions, and promotional materials are illustrative and subject to change, and no statement on the platform guarantees any specific benefit unless expressly confirmed in Event‑specific terms.

Participation and eligibility

To participate, Users must complete the prescribed registration process with current, complete, and accurate information and agree to these Terms and any Event‑specific conditions notified at checkout or within the platform.

Participation is limited to individuals competent to contract and at least twenty one (21) years of age as per Indian law.

Brewszilla may refuse, suspend, or cancel participation if eligibility or compliance requirements are not met or if required by law or platform integrity considerations.

Registration fees and taxes

All Events are paid, and the registration fee ("Registration Fee") for each Event is determined solely by Brewszilla and may be updated at any time prior to purchase.

By registering, Users agree to pay the Registration Fee plus all applicable taxes, duties, and levies (including GST, as applicable) displayed or disclosed at checkout for the relevant Event.

Registrations are personal to the Registered Participant and are non‑assignable and non‑transferable unless expressly permitted in Event‑specific terms.

Payments and gateway

Payments may be processed through the methods provided on the platform or via integrated electronic payment gateways operated by independent payment gateway service providers, and such processing is subject to those providers' terms, conditions, and privacy policies in addition to these Terms.

Users are responsible for any charges or fees imposed by their banks, card issuers, or payment providers and represent that they have the legal right to use the selected payment method.

Brewszilla does not control the operation of third‑party gateways and disclaims liability for gateway‑related errors, interruptions, or delays, without limiting any non‑waivable statutory rights under Indian law.

Records and confirmations

Electronic records, confirmations, and logs generated by the platform and/or payment providers may serve as conclusive evidence of transactions and timestamps, subject to correction of clerical or computational errors where necessary under applicable law.

Users consent to receive electronic communications and notices relating to registrations, payments, and Events.

If an error in pricing or settlement is identified, Brewszilla reserves the right to rectify and adjust the transaction consistent with the disclosed price logic and applicable Event‑specific terms.

Fraud, misuse, and security

Users must provide accurate, lawful payment details and must not use any card, account, or net‑banking facility they do not lawfully control or have rights to use.

Brewszilla may take appropriate action, including cancellation and referral to authorities, in case of suspected fraud, chargebacks arising from misuse, or violations of acceptable use and payment obligations.

Users acknowledge inherent internet risks and agree to use industry‑standard care to protect their credentials while Brewszilla implements reasonable measures consistent with applicable IT requirements and platform policies.

Changes, cancellations, and refunds

Brewszilla may modify Event parameters, reschedule, or cancel Events for operational, safety, legal, or venue‑related reasons, with reasonable efforts to notify Registered Participants where feasible.

Any refunds, credits, or alternative arrangements (if offered) will be governed by Event‑specific terms communicated at the time of purchase or as subsequently notified on the platform.

Absent any express refund obligation, changes do not entitle Users to compensation for ancillary costs such as travel or accommodation.

Conduct and safety at Events

Participants must follow Event rules, venue policies, staff instructions, and applicable laws, and must not engage in harassment, abuse, endangerment, or unlawful conduct.

Brewszilla may deny entry or remove any participant to preserve safety, comply with venue rules, or enforce acceptable use and conduct standards.

Where alcohol is served, government ID verification and legal drinking age compliance apply as per local law and venue policy, and intoxicated or unsafe behavior may result in removal without refund per Event‑specific rules.

Privacy and data

Handling of personal data for registrations and Events is governed by Brewszilla's Privacy Policy and applicable Indian IT law and rules concerning electronic records and reasonable security practices.

Sensitive personal data, if collected, will be managed in accordance with applicable rules and notified purposes, subject to consents and disclosures required by law.

Third‑party gateways and service partners may process data as independent controllers or processors under their terms, and Users should review those policies before transacting.

Intermediary compliance and grievance

To the extent Brewszilla functions as an intermediary for user interactions or content, it may implement due diligence, notice‑and‑takedown, grievance redressal, and compliance measures required by the Intermediary Guidelines and Digital Media Ethics Code Rules, 2021.

Users agree to cooperate with lawful requests and platform processes to address violations or risks to safety or rights.

Grievances relating to platform content, processes, or takedowns can be raised through the channels identified in policy notices published within the platform.

Access to the event

Each Registered Participant must carry the identity documents and credentials specified by Brewszilla to gain entry at the venue, and entry may be refused if required credentials are not produced or appear invalid.

Government‑issued photo ID and any Event‑specific confirmations may be required to verify eligibility, age, and registration status in accordance with platform policies and applicable law.

Brewszilla may deny access to protect attendee safety, comply with venue policies, and enforce these Terms where reasonable and lawful to do so.

Costs and expenses

Except for inclusions expressly stated for a specific Event, all other expenses at or around the Event (for example, travel, parking, additional food or beverages, upgrades) are solely the responsibility of the Registered Participant.

Ancillary or incidental costs are not reimbursed unless a written Event‑specific policy states otherwise at the time of purchase.

Display prices and inclusions may change before purchase; the final price and inclusions are those shown at checkout when payment is completed.

Location and venue partners

Events may be hosted at hotels, resorts, cafes, breweries, or similar properties operated by independent third parties ("Venue Partners"), and attendees must follow the venue's rules and policies in addition to these Terms.

Brewszilla does not control or guarantee the availability, quality, safety, or suitability of Venue Partners' premises, food, beverages, or facilities, which are provided on an "as is" and "as available" basis to participants.

All dealings with Venue Partners, including purchases at the venue or use of venue facilities, are at the participant's own risk and subject to the Venue Partners' terms and conditions.

Recording and media consent

By attending an Event, each Registered Participant grants Brewszilla a worldwide, royalty‑free, irrevocable license to photograph, audio/video record, live stream, edit, adapt, reproduce, display, distribute, and otherwise use their image, likeness, voice, and performance captured at the Event for platform operations, promotion, advertising, and archival purposes, in any media now known or later developed, to the extent permitted by applicable law.

Brewszilla may combine such recordings with other content, create derivative works, and sublicense usage to service providers, media outlets, and distribution partners consistent with these purposes.

Participants should not attend on‑camera segments if they do not wish to be recorded, and may contact the designated grievance or privacy channel for reasonable, context‑appropriate accommodations where feasible.

Personal property

Venue Partners may conduct security screening and may prohibit items per venue rules or legal requirements, and entry may be conditioned on compliance with such screening.

Participants bring personal belongings at their own risk and are responsible for safeguarding them; Brewszilla and Venue Partners are not liable for loss, theft, or damage except where non‑waivable rights under applicable law require otherwise.

Unattended or left‑behind items may be handled, stored, or disposed of by venue staff or Brewszilla in their discretion consistent with safety and venue policies.

Code of conduct

Registered Participants must act professionally and respectfully toward other attendees, staff, and Venue Partners, and must follow all lawful instructions issued for safety, crowd management, and Event integrity.

Brewszilla enforces a zero‑tolerance approach to harassment, threats, discrimination, and endangerment, and may remove participants without refund for violations of the code or venue rules.

Compliance includes all applicable laws and venue restrictions, including age‑restricted service rules for alcohol where relevant.

  • Do not harass, threaten, bully, or engage in abusive, obscene, hateful, or discriminatory behavior toward anyone at or around the Event.
  • Do not obstruct entrances/exits, disrupt programming, ignore safety instructions, or incite disruptive conduct by others.
  • Do not damage venue property or tamper with equipment, signage, or installations.
  • Do not impersonate others, engage in fraud, or attempt unauthorized access to restricted areas or systems.
  • Do not conduct unapproved commercial activities, solicitations, displays, or distributions at the Event.
  • Do not collect personal data from attendees without lawful basis and clear consent consistent with applicable policies.
  • Do not use, possess, or distribute illegal substances or prohibited items; comply with all local laws and venue restrictions.
  • Do not engage in or provoke violence, theft, or other unlawful acts.

Entry, removal, and refunds

Brewszilla or Venue Partners may refuse entry or remove any participant for safety risks, code violations, illegal conduct, or failure to follow reasonable venue instructions, without obligation to provide a refund unless required by an Event‑specific policy or non‑waivable law.

Failure to arrive or participate at the stated time does not create a right to reschedule or refund unless expressly provided in Event‑specific terms.

Operational delays or queue times may occur, and do not entitle participants to compensation or refunds unless explicitly stated for the Event.

Indemnity and damage

Each Registered Participant agrees to indemnify and hold harmless Brewszilla from losses, claims, damages, liabilities, and expenses arising from their breach of these Terms, unlawful conduct, or damage caused at the venue, to the extent permitted by applicable law.

Participants must compensate Venue Partners for property damage or costs attributable to their acts or omissions under the venue's rules and lawful claims processes.

This clause applies in addition to any statutory remedies available to Brewszilla or the Venue Partners under Indian law.

Removal from event

Brewszilla may deny entry, remove, ban, or eject any Registered Participant, and revoke Event access without refund where the participant breaches these Terms, behaves illegally or unsafely, disrupts the Event, or where safety, security, or order would reasonably be impacted in Brewszilla's discretion.

Such determinations may consider venue rules, lawful instructions, and crowd safety protocols, and decisions made in good‑faith for safety and compliance will be final to the extent permitted by law.

No guarantee

Events are provided on an "as is" and "as available" basis, and Brewszilla does not warrant that any Event will meet expectations or be uninterrupted, error‑free, or free of external disruptions, subject to any non‑waivable statutory rights.

No advice or information obtained from Brewszilla or Venue Partners creates any warranty unless expressly stated in Event‑specific terms.

Schedule changes

Brewszilla may cancel, postpone, reschedule, or change venues due to force majeure, regulatory directions, venue constraints, safety considerations, or other extenuating circumstances, with reasonable efforts to notify Registered Participants.

Except where an Event‑specific policy provides otherwise, such changes do not entitle participants to cancel registrations or claim compensation for incidental costs like travel or lodging.

Limited role and liability

The platform and services primarily provide information about Events and enable registration, discovery, and attendance; except where expressly stated, Brewszilla does not sell third‑party goods/services at Events and acts with a limited facilitator role for integrated services.

Brewszilla does not independently verify User profiles or submissions and disclaims responsibility for their accuracy or completeness, and users must make their own assessments before interacting with others.

Assumption of risk and release

Participation involves inherent risks, including crowd conditions, venue hazards, and exposure to communicable diseases, and attendees voluntarily assume such risks to the extent permitted by law while complying with posted health and safety instructions.

To the fullest extent allowed, participants release Brewszilla and its affiliates and partners from claims connected to Event participation, except where liability cannot be excluded under applicable law.

Exclusions and limitation

Brewszilla may correct pricing or descriptive errors and request revision or cancellation of affected transactions before fulfillment, with any remedies governed by the applicable Event policy.

Brewszilla is not liable for delays or deficiencies caused by force majeure, user acts or omissions, legal or policy restrictions, inaccurate information supplied by users, or failure to follow reasonable instructions, subject to non‑waivable rights.

Supporting environment

Use of the services requires compatible devices, software, internet connectivity, and periodic updates, and users are responsible for meeting and maintaining these requirements.

Service performance may vary due to network or device factors, and availability may change with updates or platform improvements.

Reserved rights

Brewszilla may introduce, modify, limit, or discontinue services, features, or fees, impose usage conditions, or refuse service to maintain compliance, safety, or platform integrity.

Where required by law, material changes will be communicated through the platform with effectiveness upon posting unless an alternate effective date is specified.

Regulatory compliance

Users must comply with applicable Indian laws, including the Information Technology Act, 2000 and the Intermediary Guidelines and Digital Media Ethics Code Rules, 2021, and must not use the platform for unlawful purposes.

Brewszilla may restrict, suspend, or terminate accounts for legal or policy violations and seek recovery for losses arising from misuse.

Accounts and security

Users must provide accurate, current, and complete registration data, keep credentials confidential, and promptly update any changes or report unauthorized use.

Usernames and profiles must not impersonate others, infringe rights, or be obscene or abusive, and accounts may be suspended for violations to protect the platform and users.

Platform content

Platform content provided by Brewszilla is protected by intellectual property laws and may be used only as permitted by these Terms, with all notices and restrictions retained.

Brewszilla strives for accuracy but does not guarantee completeness or timeliness of content and disclaims liability for errors to the extent permitted by law.

Limited license

Subject to these Terms, Brewszilla grants a personal, limited, non‑exclusive, non‑transferable, revocable license to access the platform for non‑commercial use of services and content.

Users must not reverse engineer, decompile, create derivative works, remove notices, or provide platform access to third parties in service bureau or similar models.

User content

Users are solely responsible for content they submit or share and warrant they have necessary rights, consents, and permissions, including for identifiable individuals in media.

Users grant Brewszilla a worldwide, perpetual, sublicensable license to use, host, reproduce, adapt, and distribute such content for operating and promoting the platform and services, consistent with applicable law and posted policies.

Intermediary rules notice

As an intermediary, Brewszilla implements due diligence and grievance processes and requires users not to post unlawful, infringing, deceptive, harmful‑to‑children, or privacy‑violating content, consistent with the IT Rules 2021.

Breach may result in content removal, account action, or lawful referral to authorities in accordance with platform policies and legal obligations.

Mandatory conduct

Participants must not harass, threaten, or endanger others; distribute malware or spam; impersonate; conduct unauthorized commerce; or interfere with security or operations of the platform or Events.

Users are responsible for actions under their accounts and devices, must implement reasonable security practices, and must notify Brewszilla of suspected breaches or misuse.

Data and recordings

If Events are recorded or live streamed, attendees consent to the capture, editing, and use of their image, voice, and performance for operational and promotional purposes in any media, with reasonable accommodations considered where feasible.

Distribution may include third‑party platforms and service partners in line with platform policies and lawful processing requirements.
