This page along with the documents referred to in it tells you the terms (the “Terms”) which apply when you use any of our Service (the Services) from our Brewszilla.com website or mobile applications and related services (each referred to as an “Application”). The terms (“us”, “we”, the “Company” or “Brewszilla”) refer to Brewszilla Technologies Private Limited.

2.   Joining Criteria and app restrictions 

If you are not over the age of 18 or atleast 18 years of age, You are not authorized to create an account or access or use the Brewszilla Service or systems. If you do not aim to comply with this Agreement and all applicable local, state, national laws, rules and regulations. If You affirm that you have not been found guilty of a felony, an offense that warrants indictment (or a crime of comparable gravity), any form of sexual offense, or crimes involving violence. Additionally, you confirm that you are not obligated to register as a sex offender with any state, federal, or local registry.

You are required to:

1. Abide by all relevant laws, including but not limited to privacy laws, intellectual property laws, anti-spam laws, equal opportunity laws, and regulatory requirements.
2. Use your authentic name and actual age when creating your Bumble account and on your profile.
3. Utilize the services in a professional manner.

You agree that you will not:

1. Engage in illegal or unprofessional behavior, including being dishonest, abusive, or discriminatory.
2. Falsify your identity, age, past or present job positions, qualifications, or affiliations with any person or entity.
3. Reveal information that you are not authorized to disclose.
4. Stalk or harass any other user of the App.
5. Participate in or operate a pyramid scheme, engage in fraud, or similar practices.
6. Develop, support, or use software, devices, scripts, robots, or any other means or processes (like crawlers, browser plugins, and add-ons or other technologies) to scrape or extract data from Brewszilla or its services, or to copy profiles and other data from the services.

 

2.   Acceptance of Terms

Please note - This is a contract between You, the user and Brewszilla, and it's important for users to understand both their own rights and those of Brewszilla before using the website or app. Users are advised to read the Terms of Service carefully, as accessing, viewing, or using the App means they are legally bound by these terms. Kindly spend a little time reading these Terms before using the App. By accessing, viewing, or using the App, you legally agree to be bound by these Terms, so it's advisable to familiarize yourself with them beforehand.

By creating an account with Us, through any electronic medium, you agree to be bound by 

(i) Terms of Use, 

(ii) Our Privacy Policy, Cookie Policy, Arbitration Procedures (is this applicable to BREWSZILLA???), Safety Tips, and Community Guidelines, each of which is incorporated by reference into this Agreement.

(iii) Any terms disclosed and agreed to by you if you purchase additional features, products or services we offer on the Service (collectively, this "Agreement"). Please do not use the Service, If you do not accept and agree to be bound by all of the terms of this Agreement.

We reserve the right to modify this Agreement and the Service periodically. The reasons for such changes can range from legal requirements, the introduction of new features, or shifts in business practices. The latest version of this Agreement will always be available under the Settings section on the Service and on brewszilla.com. It's important for you to consistently check for the most updated version, as that is the one that is applicable. If the changes significantly affect your rights or responsibilities, we will provide at least a 30-day notice before these changes take effect, through reasonable means like Service notifications or emails, unless legal constraints prevent such notice. By continuing to use the Service after these changes are effective, you are agreeing to the amended Agreement.

Please note that if you sign up for a subscription for a specified duration (referred to as the "Initial Term"), the conditions of your subscription will automatically renew for additional terms of the same length as the Initial Term. This renewal will be at Brewszilla’s current rate for such services at that time, unless you opt to cancel your subscription following the procedure outlined under Terms of Payment

3. Creation/Deletion of an Account on Brewszilla and Your Personal Data

To access and use certain parts or features of the Site, you must create an account, with each account intended for individual use only. Unfortunately, we cannot allow you to use another person’s Account or to share your Account with any other person without permission.

You have the option to set up an Account either through manual registration or by using your Gmail login credentials. If you opt to create an Account with your Gmail login, you give us permission to access, display, and utilize specific information from your Gmail account, such as profile pictures, relationship status, location, and details about your Gmail friends. For detailed information on the data we collect and its usage, please refer to our Privacy Policy. By utilizing our App, you recognize and agree to our collection and use of your data as outlined in our Privacy Policy.

If you decide to depart, you have the option to terminate your Account at any moment. This can be done by logging in, navigating to the 'Settings' page, and selecting the 'Delete account' option. Your Account will be terminated instantly, but there may be a short delay before Your Content (as defined later) is fully eliminated from the App. We will handle your profile details in compliance with our Privacy Policy. Should you choose to create a new account using the same credentials during this period after deleting your Account, we will reactivate your existing Account for you.

We may choose to suspend or delete or terminate your account on suspicious behaviour. We employ a blend of automated systems and a team of moderators to scrutinize accounts and messages, looking for indicators of violations of these Terms. We hold the right, at our discretion, to terminate or suspend any Account, limit access to the App, or implement any operational, technological, legal, or other measures to enforce the Terms (this includes, but is not limited to, blocking specific IP addresses) at any time, without any obligation and without prior notice. Specifically, we reserve the right to terminate or suspend your Account without notice if (1) you violate these terms, (2) your behavior on the App or with other App users, including "offline" activities, is deemed inappropriate or improper at our sole discretion, (3) our affiliates determine your conduct on other apps they operate as inappropriate or improper, or (4) for any reason we consider, in our sole judgment, justifiable for termination. If your Account is terminated or suspended, you acknowledge that you will not be refunded for any paid services or features you have already been charged for.

Accessing, tampering with, or using non-public areas of the App or our systems is prohibited. Some parts of the App may be inaccessible without registering for an Account.

 

Upon account creation, you agree to: 

(a) provide accurate, up-to-date, and complete account information, 

(b) keep your account information current and update it as needed, 

(c) secure your account credentials, 

(d) take responsibility for any actions or inactions of third parties who have the authority to use the Site on your behalf, and 

(e) promptly inform us of any security breaches related to the Site or your account. 

You can update your registration details by sending changes to support@brewszilla.com. Providing false, inaccurate, outdated, or incomplete information may lead to the suspension or termination of your account and could result in being barred from current or future use of the Site.

By registering, you also agree to receive electronic communications from Brewszilla, such as emails or notices on the Site. These messages may include account-related information (like payment authorizations, password changes, and transaction details) and are a part of your relationship with us. We assure you that these electronic communications will fulfill any legal requirements for written communication. You are encouraged to keep copies of our electronic communications by printing or electronically saving them. Additionally, we may send promotional emails, including newsletters, special offers, surveys, and other relevant updates. You can opt out of these promotional emails at any time by following the provided unsubscribe instructions.

 

4. License to Access and use the Site and Content
5. Grant of License:
   Brewszilla grants you a personal, non-transferable, and non-exclusive right to access and use our app and its content. This license is strictly for personal, non-commercial use, aimed at providing a fulfilling, safe, and engaging platform for brewery enthusiasts who are eager to make meaningful connections and contribute to community well-being.
6. Using Brewszilla:
   You can explore profiles, match with fellow beer lovers, plan brewery dates, participate in community service events, and share your experiences. Our app encourages not just romantic connections but also camaraderie through shared interests in craft beer and community service.
7. Content and Interactions:
   Brewszilla provides diverse content including user profiles, brewery guides, event listings, and tips for successful brewery dates that also benefit the community. We believe in fostering a positive and respectful environment. Therefore, any form of harassment, misinformation, or inappropriate conduct is strictly against our policy.
8. Community First:
   Respect for each other and the communities we serve is the cornerstone of Brewszilla. Users are encouraged to engage in community improvement initiatives and share their experiences to inspire others. Misuse of the platform for purposes other than its intended use will result in immediate action.
9. Prohibited Conduct:
   The following actions are strictly prohibited on BrewHeart:

• Illegal activities or infringement of others’ rights.
• Distribution of spam, malicious content, or unauthorized communications.
• Data scraping, unauthorized data mining, or any form of content extraction from Brewszilla.

6. Intellectual Property Rights:
   All content on Brewszilla, including texts, graphics, and interface designs, is the property of BrewHeart or its content providers, protected under intellectual property laws. Any commercial use of this content without prior permission from Brewszilla is prohibited.
7. Updates and Modifications:
   Brewszilla may undergo periodic updates and modifications to enhance user experience, introduce new features, or improve community engagement strategies. These changes are aimed at enriching your journey with us.
8. Termination of Access:
   We reserve the right to terminate or suspend access to Brewszilla if users violate these terms, engage in harmful conduct towards other users, or misuse the platform in any way.

4. Trademark
5. Ownership of Trademarks:
   "Brewszilla," including the name, logo, app design, and all related marks, are trademarks or service marks of Brewszilla (referred to as “the Company”). These trademarks are registered and/or used in India.
6. Authorized Use:
   The trademarks of Brewszilla are exclusively used for identifying our products and services. Any use of our trademarks must be with our explicit permission and in accordance with our guidelines. Unauthorized use of our trademarks for commercial purposes or in a manner that suggests sponsorship or endorsement by Brewszilla is strictly prohibited.
7. Infringement Policy:
   Any unauthorized use of Brewszilla trademarks may constitute infringement. The Company takes its intellectual property rights seriously and will enforce its rights to the fullest extent of the law. This may include legal action against individuals or entities involved in unauthorized activities.
8. Reporting Unauthorized Use:
   If you encounter any use of our trademarks that you believe infringes on our rights, please contact us at support@brewszilla.com We appreciate your help in protecting our brand.
9. No Implied Affiliations:
   Use of the Brewszilla name or trademarks must not imply any affiliation with, endorsement by, or sponsorship by the Company unless such a relationship has been formally established through a written agreement.
10. Use in Media and Publications:
    Media outlets, bloggers, and third-party publications wishing to use our trademarks in connection with news, articles, or similar media must ensure that such use complies with this policy and does not misrepresent the Company or its services.
11. Modification and Revocation:
    Brewszilla reserves the right to modify this Trademark Policy at any time. The Company also reserves the right to revoke any granted use of its trademarks, should such use be found in violation of these terms.

6. Content - User and Brewszilla

User Content

1. Definition: User Content refers to any text, images, messages, reviews, data, information, or other material that users post, upload, or share on the Brewszilla app, including profiles, messages, and any interactions within the community.
2. Responsibility: You are solely responsible for your User Content. You warrant that you own all intellectual property rights to your content or have obtained necessary permissions or licenses.
3. Permission to Use: By posting User Content on Brewszilla, you grant the Company a non-exclusive, worldwide, royalty-free, perpetual license to use, display, edit, modify, reproduce, distribute, store, and prepare derivative works of your User Content. This license is for the sole purpose of operating, developing, providing, and using the Brewszilla Connect services.
4. Prohibited Content: User Content must not infringe on any intellectual property rights, violate any laws, or contain offensive, defamatory, explicit, or harmful material. Content promoting harmful or illegal activities, especially those against environmental safety and community well-being, is strictly prohibited.
5. Content Removal: Brewszilla reserves the right to review, edit, or delete User Content that we deem inappropriate, offensive, or in violation of these Terms.

Company Content

1. Ownership: All content provided on Brewszilla, including but not limited to texts, graphics, logos, images, as well as the design, structure, selection, coordination, and arrangement of such content, is owned by or licensed to Brewszilla ("Company Content").
2. Use of Company Content: Company Content is available to you for your information and personal use only. It must not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of Brewszilla.
3. Protection of Intellectual Property: Company Content is protected by copyright, trademark, and other intellectual property laws. Brewszilla strictly prohibits the use of its content for any unauthorized purpose.
4. No Endorsement: Company Content may include or offer third-party products, services, activities, or events. The presence of such content does not constitute an endorsement by Brewszilla, and users are advised to exercise caution and abide by the terms of third parties.

By agreeing to these Terms of Service, users acknowledge and agree to adhere to the guidelines set forth for both User Content and Company Content on Brewszilla. Our goal is to provide a platform that not only fosters connections and love for breweries but also champions the cause of cleaner, greener communities.

 

7. Terms of Payment 

By choosing to use any of Brewszilla’s paid features, you agree to these terms:

1. Subscription Fees:
   Brewszilla offers various subscription packages for its premium features. Fees for these subscriptions will be stated clearly in the app. All fees are charged in advance and are non-refundable, except as expressly provided in these terms.
2. Automatic Renewal:
   Your subscription will automatically renew at the end of each subscription term for a similar period unless you cancel it before the renewal date. You will be charged the renewal subscription fees through the payment method you have on file.
3. Free Trials:
   Brewszilla may offer free trials for a limited period for first-time subscribers. You must cancel the subscription before the end of the trial period to avoid being charged the subscription fee.
4. Payment Method:
   Payments can be made via accepted credit cards, PayPal, or other approved payment methods. By submitting your payment details, you confirm that you are authorized to use the designated payment method.
5. Late Payments:
   If payment is not received by the due date, your access to premium features may be suspended or terminated. Continued non-payment may result in cancellation of your subscription.
6. Price Changes:
   Brewszilla reserves the right to adjust pricing for its services or any components thereof in any manner and at any time. Any price changes will take effect following email notice to you.
7. Refunds:
   Refunds are generally not provided for any subscription services unless required by law. However, exceptional circumstances will be considered on a case-by-case basis at Brewszilla’s discretion.
8. Cancellation:
   You can cancel your subscription at any time. The cancellation will take effect at the end of the current billing period. You will retain access to the premium features until the end of your billing cycle.
9. Billing Disputes:
   If you believe you have been billed in error, you must contact us within 30 days of the billing date. Brewszilla will not issue refunds or credits for any charges more than 30 days old.
10. Taxes:
    All fees are exclusive of applicable national, state, local or other taxes (“Taxes”). You are responsible for all applicable Taxes that arise from or as a result of your subscription to or purchase of Brewszilla’s services. These Taxes are based on the rates applicable to the billing address you provide to us and will be calculated at the time of your purchase. If you are exempt from payment of such Taxes, you must provide us with evidence of your exemption, which in some jurisdictions includes an original certificate that satisfies applicable legal requirements attesting to tax-exempt status. Tax exemption will only apply from and after the date we receive such evidence.

By subscribing to our premium services, you acknowledge and agree to these Terms of Payment, including the responsibility for the payment of any applicable Taxes.

8. Push Notification

The below outlines our policy regarding push notifications. By using Brewszilla, you agree to these terms:

1. Consent to Push Notifications:
   When you create an account on Brewszilla, you will be asked whether you wish to receive push notifications about your account activity, new matches, messages, updates from Brewszilla, and other relevant alerts. By agreeing to receive these notifications, you are consenting to our sending them to your device.
2. Types of Notifications:
   The push notifications you might receive include, but are not limited to:

• Alerts about new matches or messages.
• Alerts about new breweries
• Alerts about special offers at a brewery
• Alerts about meetups, events at a brewery, new connections
• Updates on nearby brewery events or dating opportunities.
• Tips and suggestions for enhancing your dating experience.
• Notifications about changes to Brewszilla features or policies.
• Community alerts related to brewery volunteering events or eco-friendly initiatives.

3. Managing Notifications:
   You can manage your push notification preferences or opt-out of receiving these notifications at any time through the settings on your device. Please note that opting out of push notifications may impact your use of certain features of the app.
4. No Guarantee of Delivery:
   While we aim to deliver timely and accurate notifications, we cannot guarantee that you will receive every notification. Delivery may be affected by factors beyond our control, such as your device settings or network connectivity.
5. Changes to Notification Policy:
   Brewszilla reserves the right to modify this push notification policy at any time. We will notify you of any significant changes through the app or via other means, like email.
6. No Liability:
   Brewszilla is not liable for any loss or damage arising from your receipt or non-receipt of push notifications. You are responsible for ensuring your device settings are configured to receive notifications as desired.

By using Brewszilla, you acknowledge that you have read and understood this Push Notification Policy and agree to its terms. 

9. Location Based Features

The following outlines our policy regarding the use of location features within the BrewLuv app. By using BrewLuv, you agree to these terms:

1. Consent to Use of Location Services:
   Brewszilla’s unique experience is built around the use of location services. By enabling location services on your device, you consent to our collection, use, and sharing of your location data in accordance with our Privacy Policy. This includes using your location to show nearby breweries, suggest matches in your area, and provide location-based features and content. You can opt out by either following the specific instructions included in such communications, or by emailing us with your request at support@brewszilla.com.
2. Purpose of Location Data:
   The location data collected by Brewszilla is used to:

• Enhance your matchmaking experience by connecting you with potential matches who share your interest in breweries and are within your vicinity.
• Inform you about local brewery events, meetups, and dating opportunities.
• Customize the app’s content to your local brewery scene and dating preferences.

3. Control of Location Services:
   You have full control over the location services feature. You can enable or disable it at any time through your device’s settings. Please note that turning off location services may limit certain functionalities of the app and affect your overall experience.
4. Accuracy of Location Data:
   Brewszilla strives to provide accurate location-based services; however, we cannot guarantee perfect accuracy. The precision of location data may vary based on several factors, including your device settings, environment, and network.
5. Sharing of Location Data:
   Brewszilla values your privacy. We will not share your precise location data with other users. Only general information like city or neighborhood may be shown to matches, in accordance with our Privacy Policy.
6. Changes to Location Feature Policy:
   Brewszilla reserves the right to modify this policy at any time. Any changes will be communicated through the app or via email.
7. No Liability for Location Data Usage:
   Brewszilla is not responsible for any loss or damage arising from your use of the location services feature. You are responsible for managing your location settings and understanding the implications of sharing your location data.

By using Brewszilla and enabling location services, you acknowledge that you have read, understood, and agreed to this Location Feature Policy.

10. Legal Requirements 

This section outlines the legal requirements and compliance under our Terms of Use. When Brewszilla is the data controller, we will decide how your personal data is processed and for what purposes. For additional information about your rights, please see Brewszilla’s Privacy Policy located at Privacy Policy. By using Brewszilla, you agree to adhere to these legal stipulations:

1. Age Requirement:
   You must be at least 18 years of age to create an account on Brewszilla and use its services. By registering, you certify that you meet this age requirement, which is in compliance with Indian laws regarding legal adulthood and consent.
2. Compliance with Indian Law:
   Brewszilla operates in accordance with the laws and regulations of India. Users must ensure that their conduct on the app, both in interactions with other users and in the content shared, adheres to all applicable Indian laws, including but not limited to the Information Technology Act, 2000, and the Indian Penal Code, 1860.
3. Prohibited Conduct:
   Engaging in any illegal activities on Brewszilla, including harassment, hate speech, spreading obscenity, or promoting violence, is strictly prohibited and may lead to legal action and termination of your account.
4. Respect for Privacy and Data Protection:
   In compliance with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, Brewszilla is committed to protecting the privacy and security of our users’ personal data. Please refer to our Privacy Policy for details on how we collect, use, and protect your information.
5. Intellectual Property Rights:
   All content on Brewszilla, including the app interface, graphics, and text, is the property of Brewszillaor its licensors and is protected under Indian intellectual property laws. Unauthorized use, reproduction, or distribution of this content is prohibited.
6. Reporting Violations:
   If you encounter any content or behavior that violates these terms or Indian law, please report it immediately through the app’s reporting feature or contact our support team.
7. Modifications to Legal Requirements:
   Brewszilla reserves the right to modify these legal requirements to maintain compliance with Indian law. Changes will be communicated to users through the app or via email.
8. Jurisdiction and Dispute Resolution:
   Any disputes arising under these terms will be governed by and interpreted in accordance with the laws of India. Disputes will be subject to the exclusive jurisdiction of the courts in [Specify Jurisdiction].

10. Rules that need to be followed

   Treat all users with respect. Abusive, harassing, discriminatory, or offensive language and behavior are strictly prohibited. Respect others' opinions and beliefs, and engage in conversations constructively.
2. Authenticity:
   Be honest and authentic in your interactions. Use your real name and provide accurate information in your profile. Misleading other users through false information is not tolerated.
3. Appropriate Content:
   Only post content that is appropriate and relevant to the app’s focus on brewery exploration and dating. Inappropriate content, including nudity, hate speech, or violent imagery, is strictly prohibited.
4. No Spam or Commercial Activity:
   Spamming other users or using the community for commercial purposes, such as advertising goods or services, is not allowed. Focus on making genuine connections based on shared interests in breweries and dating.
5. Respect Privacy:
   Respect the privacy of others. Do not share private information about other users without their explicit consent. This includes personal contact details, private messages, and photos.
6. Safety First:
   Prioritize your safety and the safety of others. When meeting in person, choose public places and inform someone of your plans. Report any users who engage in unsafe or suspicious behavior.
7. Report Violations:
   If you encounter behavior or content that violates these Community Rules, report it to us immediately through the app’s reporting features or customer support.
8. Compliance with Local Laws:
   Adhere to all applicable local laws and regulations. Do not engage in or encourage illegal activities through the app.
9. No Tolerance for Harmful Behavior:
   Any form of exploitation, abuse, or harmful behavior towards other members will result in immediate action, including potential removal from the app and reporting to relevant authorities, if necessary.
10. Changes to Community Rules:
    BrewTogether reserves the right to modify these Community Rules at any time to ensure a safe and respectful environment for all users.

By using BrewTogether, you commit to upholding these Community Rules and contributing to a positive and respectful community where brewery enthusiasts and singles can connect and find meaningful experiences. 

11. Feedback

This section of our Terms of Use is dedicated to our Feedback Policy. We value your input and encourage you to share your thoughts and suggestions with us.

1. Encouragement of Feedback:
   Brewszilla invites and encourages you to provide feedback, comments, and suggestions for improvements to the App ("Feedback"). Whether it's about a feature you love, a function you believe could be enhanced, or a new idea entirely, we're eager to hear what you have to say.
2. Submission of Feedback:
   Feedback can be submitted via the App, through our designated feedback channels, or via email to our customer support team. We welcome all forms of constructive feedback, be it positive or critical.
3. Use of Feedback:
   By submitting any Feedback, you agree that:

• We are free to use, disclose, reproduce, license, distribute, and exploit this Feedback in any manner, without any obligation or compensation to you.
• We may use the Feedback to improve our services, develop new features, and enhance user experience.
• Your Feedback will not be treated as confidential information.

4. Intellectual Property Rights in Feedback:
   You retain ownership of any intellectual property rights that you hold in the Feedback. By submitting Feedback, you grant Brewszilla a worldwide, perpetual, irrevocable, royalty-free license to use and incorporate into Brewszilla services any suggestion, enhancement request, recommendation, correction, or other feedback provided by you.
5. No Obligation:
   While we are eager to hear your ideas and feedback, please understand that we are under no obligation to act on any Feedback provided, nor are we obliged to implement any specific changes based on your input.
6. Feedback and User Content:
   Feedback is considered a type of User Content and is subject to the terms and conditions related to User Content in the Brewszilla Terms of Use.
7. Appreciation of Feedback:
   We greatly appreciate your efforts to contribute to the improvement of Brewszilla. Your Feedback helps us to continually evolve and provide the best possible experience for our brewery-loving community.

12. Linked Sites

This section of our Terms of Use outlines our policy on linked websites or external resources ("Linked Sites"). By using Brewszilla, you acknowledge and agree to the terms outlined here:

1. Linked Sites:
   Brewszilla may contain links to third-party websites, resources, and advertisers (collectively, "Linked Sites"). These Linked Sites are provided solely as a convenience to our users and not as an endorsement by Brewszilla of the contents on such Linked Sites.
2. No Control Over Linked Sites:
   Brewszilla does not have control over, and is not responsible for, the availability of Linked Sites or their contents. The inclusion of any link does not imply affiliation, endorsement, or adoption by Brewszilla of the site or any information contained therein.    Your interaction with any Linked Site, including payment and delivery of goods or services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and the third-party. Brewszilla shall not be responsible or liable for any part of such dealings or promotions.

   You should exercise caution and look at the privacy statement and terms of use of any Linked Sites that you visit. We encourage you to be aware when you leave our app and to read the terms and conditions and privacy policy of each Linked Site that you choose to use or interact with.
5. Changes to Linked Sites:
   Brewszilla reserves the right to terminate any link or linking program at any time. We may, in our discretion, remove links to Linked Sites that are inappropriate or inconsistent with BrewHeart’s brand and reputation.
6. Feedback on Linked Sites:
   If you have concerns or queries regarding any of the Linked Sites, we welcome your feedback. However, such feedback will not change our policies and practices unless we find it necessary.

By using Brewszilla, you expressly relieve us from any and all liability arising from your use of any Linked Site. 

13. Indemnification

   In the event that you are involved in any way in violating any of the terms of use or legal rights of others, including but not limited to intellectual property rights, privacy rights, or the distribution of harmful or illegal content, you will be responsible for all damages, legal fees, and other costs that arise due to these violations.
3. Notification of Claim:
   In the case of any claim that is subject to indemnification under these terms, Brewszilla will provide you with written notice of such claim, suit, or action. Brewszilla will have the right to conduct its own defense of any claims at its own discretion, and you shall not settle any such claim without Brewszilla’s prior written consent.
4. Cooperation in Defense:
   You agree to cooperate fully with Brewszilla in the defense of any claim. Brewszilla reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you will not in any event settle any claim without the prior written consent of Brewszilla.
5. Limitation of Indemnification:
   This indemnification obligation will survive the termination of your Brewszilla account and your use of the app.

   Brewszilla is not responsible for the conduct, whether online or offline, of any user of the app. We do not perform background checks on our users and do not verify the statements of our users. You agree to take reasonable precautions in all interactions with other users, particularly if you decide to communicate outside of the app or meet in person.
3. No Guarantee of Match Success:
   Brewszilla does not guarantee that you will find a match, achieve any specific outcomes from using the app, or that any relationships formed through the app will be successful or meet your expectations.
4. Third-Party Content and Services:
   The app may contain links to third-party websites, services, and advertisements (collectively, “Third-Party Content”). Brewszilla is not responsible for the availability of these Third-Party Contents and does not endorse or warrant the offerings of any of these entities/individuals or their websites.

3. License to Use EcoBrew Social:
   We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use Brewszilla for your personal, non-commercial purposes, subject to your agreement with these Terms of Use. This license does not include any right to resell or commercially use our services or content; collect and use any product listings, descriptions, or prices; or any derivative use of Brewszilla and its contents.
4. User-Generated Content:
   You may be able to post, upload, or contribute content to Brewszillal, such as profile information, photos, messages, reviews, and other materials (collectively, "User Content"). You retain all rights in, and are solely responsible for, the User Content you post. However, by submitting User Content, you grant Brewszilla a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, perform, display, distribute, and otherwise disclose to third parties any such material for any purpose, in accordance with our Privacy Policy.
5. Reporting Infringement:
   If you believe that your intellectual property rights have been infringed upon by our app, please notify us promptly so we can address your concerns. We respect the intellectual property rights of others and expect our users to do the same.
6. No Unauthorized Use:
   Copying, modifying, distributing, selling, or leasing any part of Brewszilla or included software, nor may you reverse engineer or attempt to extract the source code of that software, except to the extent laws prohibit these restrictions, is strictly prohibited.

   You acknowledge that Brewszilla involves certain risks, including but not limited to the reliability of user profiles, the accuracy of information, and the potential of encountering harmful behavior from other users. You agree to assume all risks associated with your use of the app, to the extent permitted under Indian law.
2. Limitation of Liability:
   To the fullest extent permitted by applicable law, Brewszilla, its affiliates, officers, directors, employees, agents, suppliers, or licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your access to, use of, or inability to access or use the services;
• Any conduct or content of any third party on the services, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties;
• Any content obtained from the services; or
• Unauthorized access, use, or alteration of your transmissions or content.

3. Cap on Liability:
   In no event will Brewszilla aggregate liability for all claims relating to the services exceed the greater of INR 1000 or the amount you paid Brewszilla, if any, in the last 12 months.
4. User Responsibility:
   You are responsible for your interactions with other Brewszilla users. We reserve the right, but have no obligation, to monitor disputes between you and other users. Brewszilla disclaims any liability related to your interactions with other users or your participation in any activities or events organized through the app.
5. Jurisdictional Limitations:
   As some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, Brewszilla’s liability in such jurisdictions shall be limited to the extent permitted by law.

By using Brewszilla, you acknowledge that you understand and agree to these limitations of liability. We are dedicated to providing a safe and enjoyable experience for our users but remind you to use discretion and judgment in your interactions on the app. 

15. Claims of copyright infringement 

In accordance with Indian law, this section outlines the procedure for addressing claims of copyright infringement within the Brewszilla app. By using Brewszilla, you agree to follow these procedures if you believe your copyright has been infringed:

1. Notification of Infringement:
   If you believe that your copyrighted work has been reproduced, displayed, or used on Brewszilla in a way that constitutes copyright infringement, you should notify our Copyright Agent in writing. Your notification must include:

• A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
• Identification of the copyrighted work claimed to have been infringed.
• Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material.
• Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and, if available, an electronic mail.
• A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2. Response to Notification:
   Upon receipt of a proper notification of alleged copyright infringement, Brewszilla will follow the procedures outlined under the Indian Copyright Act, 1957, and the Information Technology Act, 2000, including removing or disabling access to the allegedly infringing material.
3. Counter-Notification:
   If the user who posted the material believes that the material was removed or access was disabled by mistake or misidentification, the user can send a counter-notification with the following information:

• User’s physical or electronic signature.
• Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled.
• A statement under penalty of perjury that the user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
• User’s name, address, telephone number, and, if available, an email address, and a statement that the user consents to the jurisdiction of the Federal Court for the judicial district in which the address is located, or if the user’s address is outside of India, for any judicial district in which Brewszilla may be found, and that the user will accept service of process from the person who provided notification or an agent of such person.

4. Take Down Process:
   Brewszilla will promptly notify the complaining party of a counter-notification and, in appropriate circumstances, will restore the removed content or cease disabling access to it.
5. Repeat Infringers:
   In accordance with Indian law, Brewszilla reserves the right to terminate user accounts that are the subject of repeated copyright infringement notifications.

16. Third Party App store

This section of our Terms of Use outlines the guidelines and acknowledgments pertaining to Third-Party App Stores from which you may have downloaded the Brewszilla app, in accordance with Indian law. By using Brewszilla, you agree to these terms.

1. Acknowledgment of Third-Party App Store Providers:
   Brewszilla is made available through app stores provided by third-party companies such as Apple’s App Store, Google Play, or other platforms ("Third-Party App Stores"). You acknowledge that this agreement is between you and Brewszilla, not with the Third-Party App Store providers, and that Brewszilla, not the Third-Party App Stores, is solely responsible for the app and its content.
2. Terms of the Third-Party App Store:
   Your use of Brewszilla  must comply with the Terms of Service of the Third-Party App Store from which you downloaded the app. You must ensure that you have read and agreed to their terms and conditions.
3. Access and Use:
   The Third-Party App Store provider has no obligation whatsoever to provide any maintenance and support services with respect to Brewszilla. Brewszilla is responsible for providing customer support and addressing any claims relating to the app, such as product liability claims, legal compliance, or intellectual property infringement.
4. Warranty and Liability:
   In the event of any failure of the Brewszilla app to conform to any applicable warranty, you may notify the Third-Party App Store provider, and the provider may refund the purchase price for the app to you (if applicable). Beyond the refund, neither Brewszilla nor the Third-Party App Store provider shall have any other warranty obligation whatsoever with respect to the app.
5. Third-Party Beneficiary:
   You acknowledge and agree that the Third-Party App Store providers, and their subsidiaries, are third-party beneficiaries of these Terms of Use for Brewszilla, and that upon your acceptance of the terms and conditions of these Terms of Use, the Third-Party App Store provider will have the right (and will be deemed to have accepted the right) to enforce these Terms of Use against you as a third-party beneficiary thereof.
6. Compliance with Legal Regulations:
   You agree to comply with all applicable domestic and international laws, statutes, ordinances, and regulations that apply to the use of the Brewszilla  app and any Third-Party App Store services.

By downloading and using Brewszilla from any Third-Party App Store, you acknowledge and agree to these terms, ensuring a seamless and compliant experience with our platform.

17. Resolution of Dispute

This section of our Terms of Use, in accordance with Indian law, outlines the procedures for the resolution of disputes arising from the use of Brewszilla. By utilizing Brewszilla, you agree to the following terms:

1. Informal Dispute Resolution:
   Before filing any claim against Brewszilla, you agree to attempt to resolve the dispute informally by contacting us. We will try to resolve the dispute informally by contacting you via email. Most disputes can be resolved in this manner, and this is the most efficient way to address issues.
2. Formal Resolution:
   If the dispute is not resolved through informal negotiation within 60 days of notification, either party may initiate formal proceedings in accordance with these terms.
3. Governing Law:
   These Terms of Use and any action related thereto will be governed by the laws of India without regard to its conflict of laws provisions. The exclusive jurisdiction and venue of any action with respect to the subject matter of these Terms of Use will be the courts located in Bangalore, and each of the parties hereto waives any objection to jurisdiction and venue in such courts.
4. Arbitration Agreement:
   For any dispute you have with Brewszilla, you agree to first contact us and attempt to resolve the dispute informally. If we are not able to resolve the dispute informally, we both agree to resolve any claim, dispute, or controversy (excluding any Brewszilla claims for injunctive or other equitable relief) by binding arbitration under the Arbitration and Conciliation Act, 1996, as amended. The arbitration will be conducted in Bangalore, in English, and the award of the arbitrator shall be final and binding upon both parties.
5. No Class Actions:
   You may only resolve disputes with us on an individual basis and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action.
6. Time Limitation on Claims:
   You agree that any claim you may have arising out of or related to your relationship with Brewszilla must be filed within one year after such claim arose; otherwise, your claim is permanently barred.

This Resolution of Disputes section shall survive any termination of your account or the Brewszilla services. We believe that addressing disputes promptly and efficiently is in the best interest of all parties involved and we are committed to providing a fair resolution mechanism.

18. Termination and Severability

This section details the Termination Policy under our Terms of Use, as per Indian law. By using Brewszilla, you acknowledge and agree to these terms.

1. User Initiated Termination:
   You may terminate your account with Brewszilla at any time and for any reason by following the account deletion process provided in the app. Upon termination, your account will be deactivated, and your profile and any associated data will no longer be accessible.
2. Termination by Brews & Bonds:
   Brewszilla reserves the right to suspend or terminate your account and access to the app without notice, at its sole discretion, if:

• You breach any terms of these Terms of Use.
• Your actions are found to be harmful to other users, the community, or the environment.
• You engage in fraudulent, abusive, or illegal activities.
• Your account remains inactive for an extended period.

3. Effects of Termination:
   Upon termination:

• All rights granted to you under these Terms of Use will immediately cease.
• You must stop all use of the app and uninstall it from your devices.
• Any fees paid to Brewszilla are non-refundable.

4. Survival of Terms:
   The termination of your account or use of the app will not affect any of our rights or your obligations arising before the termination.
5. Post-Termination Handling of User Data:
   Upon account termination, we may retain some of your data for a certain period as necessary to comply with our legal obligations, resolve disputes, enforce our agreements, or for other legitimate business purposes.

   In the event of termination of your account by Brewszilla, we will provide you with notification via the email address associated with your account, where possible.

This section outlines the Severability clause under our Terms of Use, in accordance with Indian law. By using Brewszilla, you agree to these terms.

1. Severability Clause:
   If any provision of these Terms of Use is held by a court of competent jurisdiction to be contrary to law, such provision shall be modified by the court and interpreted so as best to accomplish the objectives of the original provision to the fullest extent allowed by law, and the remaining provisions of these Terms of Use shall remain in effect.
2. Maintaining Intent:
   Brewszilla’s intent is to ensure all provisions of these Terms of Use are valid and enforceable. In the event that any provision is found to be invalid or unenforceable, Brewszilla and the user agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision.
3. Continuation of Terms:
   An invalid or unenforceable provision will not affect the other provisions of the Terms of Use, and all other parts of these Terms will continue in full force and effect.
4. Future Amendments:
   Brewszilla reserves the right to amend these Terms of Use at any time. Amendments will be effective upon posting of the updated terms on the app or website. Your continued use of the app following the posting of the updated terms will mean that you accept and agree to the changes.
5. Jurisdictional Considerations:
   The Severability clause is in compliance with applicable Indian laws and regulations. It is designed to ensure the resilience and enforceability of these Terms of Use within the legal framework of India.

   All notices provided by Brewszilla under these Terms of Use will be delivered via email, regular mail, or postings on the app or website.
5. Notices from You or User

7. Governing Law and Jurisdiction:
   These Terms of Use and your use of the app are governed by the laws of India, without regard to conflict of law principles. You and Brewszilla agree to submit to the exclusive jurisdiction of the courts located within India to resolve any legal matter arising from the Terms.
8. Amendments to the Terms:
   Brewszilla reserves the right to modify these Terms of Use at any time. You are encouraged to review the Terms periodically for any changes. Your continued use of the app following the posting of revised Terms of Use means you accept and agree to the changes.
9. Headings:
   The headings in these Terms of Use are for convenience only and have no legal or contractual effect.
10. Survival:
    Any provisions of these Terms of Use that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
